1. Security Advice

Kitesurfing cannot be learned without qualified instruction! Attempting to learn kitesurfing on your own will seriously endanger yourself and others. In your own interest learn kitesurfing with a professional instructor. We don’t offer kitesurfing courses, however we are glad to help you find an appropriate kitesurfing school for you.

2. Delivery

We send your order as fast as possible. In case of delays on our behalf we will inform you, if available over your email address. We are not responsible for delays caused by third parties.

3. Prices

Those prices apply which are represented on our website at the time of the order. A correction of obvious mistakes is reserved, whereby we will give you the opportunity to withdraw from the purchase in the case of price corrections.

4. Value Added Tax (VAT)

The VAT-rate in Germany is 19%. In the case of supplies to countries of the European Union we charge 19% VAT likewise. In the event of supplies to countries outside of the European Union we sell free of VAT. Consider that you probably will have to pay VAT and customs on receipt. Please inform yourself about the import regulations of your country.

5. Return Policy

You may return ordered items within 14 days of receipt. Contact us within this period. If you make an oral request of return, you should - in your own interest - state this request in writing additionally, preferably by email to i n f o @ l u n a t i c . e u or fax (++49 1212 531 465 908).

To comply to the return period of 14 days it is sufficient if you dispatch the items or the request within 14 days of receipt. We will refund the full purchase price back to you if the commodity is returned in perfect condition. With a degradation of items (e.g. wear, damages, marks, etc.) indemnification can be requested. You can avoid indemnification by not taking the items in use like an owner and omitting everything that impairs their value.

Please return the items safely packed, preferably in the original packaging, to Lunatic Kiteboarding e.K., Douzystr. 51, 67661 Kaiserslautern, Germany. Send back the commodity by standard parcel services only. We will refund you the standard shipping costs for return shipments within Germany, but not for return shipments coming from abroad. Express surcharges and other expenses will only be refunded on special agreement.

Please do not return items using Freight Collect or Cash on Delivery services. We will not accept parcels sent to us in this way.

6. Warranty

In addition to the individual manufacturer’s warranties the national legal warranty claims remain effective. For example, end customers in Germany are entitled to a national legal warranty claim of two years from the date of purchase.

7. Reservation of Ownership

Until complete settlement of all claims against the customer the delivered goods shall remain our property.

8. Place of Performance, Venue, and Applicable Right

Applicable right is the right of the Federal Republic of Germany.

If the customer is a legal entity of the public right or public special estate, the place of performance for supplies and place of jurisdiction is our company headquarters, respectively Kaiserslautern, Germany.

If the customer does not have a general venue in Germany or if the customer moves its domicile or usual place of residence out of the Federal Republic of Germany after conclusion of contract, our company headquarters is place of jurisdiction. This also applies, if the customer's domicile or usual place of residence is unbeknown.

9. Final Provision

Lunatic Kiteboarding expresses reservation to change these General Terms and Conditions at any time and without indication of reasons. By ordering you accept the General Terms and Conditions valid to the time of order.

Privacy

We appreciate your visit to our web pages and thank you for your interest in our products. The protection of your privacy and your personal data is important to us. Therefore we adhere strict to the rules of the Data Protection Acts.

In general the web server stores anonymous information transmitted by your web browser in log files. These are your computer's operating system, browser type and version, name of your internet provider, time of server inquiry, the web page that referred you to us (referrer URL) and the web pages you visited on our site. This data cannot be assigned to certain persons, i.e. you remain anonymous. A unification of this data with other data sources is not made.

4. Cookies

If your browser accepts cookies, our webshop may for example utilize them to store contents of your shopping cart. Cookies enable us to offer you more user-friendly, more effective, and safer contents. Cookies are small text files which your browser stores on your computer. Mainly these cookies are session cookies. Session cookies are deleted automatically when you close your browser. Cookies cause no damage on your computer and do not contain viruses.

5. Newsletter

If you subscribe to our newsletter system, we only need a valid email address from you. In the process of registration our system sends you an email with an activation link where you are asked to confirm the entry. This way we ensure that you are actually the owner of the indicated email address and that you comply with the receipt of our newsletters. You may recall the storage of your email address as well as its use for the dispatch of newsletters to you at any time.
